To register a trademark in a foreign country

First of all, there are different ways to apply for a trademark, depending on the country where the trademark is to be registered. How to apply for a trademark overseas is roughly classified as follows.

Firstly, overseas trademark applications can be filed directly to the individual country that wants protection of trademark through a local patent attorney in each country. Usually, the trademark applications are filed claiming priority under Paris Convention, which is called also "trademark application through Paris route". It is necessary to follow the laws and procedures in the relevant country. For the entire procedure from application to registration, a local patent attorney is appointed as a legal expert in the relevant country. Thus, it is possible to secure the right which is more stable and suitable for the circumstances of the local country.

Secondly, Madrid system, including the Madrid Agreement and the Madrid Protocol, can be utilized. This is a method capable of enjoying the benefits of trademark application in all designated countries only by simply submitting one English language application to the International Bureau (WIPO). Since no overseas local patent attorneys' fees occur at the stage of application and registration, it is relatively inexpensive. The regulation is forced to notify the results of the examination within 18 months, and so it is possible to secure the right quickly.

In addition, after registration, a designated country can be added at any time (post-designation), and the name change, assignment registration, renewal etc. can be collectively filed through the International Bureau, and thus, trademark management is very easy.
